Terms & Conditions

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Member") and Epic Fitness Studio ("the Studio," "we," "us"), located at 3rd Floor, MISHRA TOWERS, Balajipeta Road, Rajamahendravaram, Andhra Pradesh. By signing the Studio Registration Form, purchasing a membership, or accessing any facility or service, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety.

1. Eligibility

  • Minimum Age: Membership is open to individuals aged 16 years and above. Members under 18 must have a parent or legal guardian co-sign the Registration Form.
  • Health Declaration: By joining, you confirm that you are in adequate physical health to participate in gym and fitness activities. Members with pre-existing medical conditions must obtain clearance from a qualified physician before commencing training.
  • Identification: A valid government-issued photo ID must be submitted at the time of registration and may be requested upon entry.

2. Membership & Financial Protocol

  • Final Sale: All payments for memberships, registration fees, and personal training are strictly non-refundable and non-cancellable.
  • No Refund Policy: Under no circumstances will monetary refunds be issued once a payment is processed.
  • Membership Transfers: Memberships may be transferred to another eligible individual for a one-time processing fee of ₹1,500. Transfers must be approved by Management and completed via official channels.
  • Authorized Payments: All payments must be made through the official studio application or the front desk. Payments made directly to staff members are not recognized by the Studio.
  • Non-Transferable Membership: Memberships are personal and cannot be shared, lent, or used by any person other than the registered member.
  • Pricing Revisions: The Studio reserves the right to revise membership pricing with a minimum of 30 days' advance notice to existing members via the official app.

3. Medical Adjustment Policy

  • No Cash Back: Medical emergencies do not qualify for monetary refunds under any circumstances.
  • Adjustment Period: In the event of a documented medical issue, Management may grant a membership freeze for a maximum of one (1) month per membership term. Freeze periods do not reset or accumulate.
  • Verification: Official medical documentation (doctor's certificate or hospital records) must be submitted to Management within 7 days of the medical event for approval of any adjustment.
  • Freeze Activation: Approved freezes will be applied prospectively; no retrospective adjustments will be made for periods already elapsed.

4. Strict Anti-Bribery Policy

  • Prohibition of Tips: Giving tips, gratuities, or direct 'offline' payments to trainers or staff for any service is strictly prohibited.
  • Bribe Classification: Any payment made outside of official studio channels will be treated as a bribe and reported to Management immediately.
  • Immediate Termination: Violation of this policy results in the immediate and permanent cancellation of the member's membership without refund, and disciplinary action — including termination — of the involved staff member.

5. Studio Etiquette & Hygiene

  • Mandatory Footwear: Clean, indoor-only athletic shoes are mandatory in all workout zones. Outdoor footwear is strictly prohibited on the floor.
  • Treadmill Regulations: Dedicated gym shoes are required. Usage is capped at 20 minutes per session during peak hours to ensure fair access for all members.
  • Dress Code: Members must wear decent and appropriate athletic attire at all times. Management reserves the right to deny entry to anyone deemed improperly dressed.
  • Hygiene Standards: Members must carry a personal towel and wipe down all equipment after every use. Re-racking weights and returning equipment to its designated location is mandatory.
  • Prohibited Substances: Smoking, tobacco products, alcohol, and recreational drugs are strictly prohibited on all studio premises.
  • Mobile Phones: Members are requested to keep phone calls brief and at a low volume inside the workout floor. Photography or videography of other members without their explicit consent is strictly prohibited.

6. Facility Usage & Asset Protection

  • Asset Liability: Members are financially responsible for any damage caused to studio property, including Split AC Units, gaming consoles, gym equipment, and any other studio assets. The cost of repair or replacement shall be charged to the responsible member.
  • Gaming & Recreation: Access to the PS5 and Table Tennis area is a privilege governed by a 'Fair Use Policy.' Members must be mindful of others waiting and adhere to time limits set by Management.
  • Storage: All bags and outdoor gear must be stored in the provided lockers. Personal items are not permitted on the workout floor. The Studio is not responsible for theft or loss of personal belongings.
  • Access Restrictions: Members may only access areas and facilities covered by their membership plan. Unauthorized access to restricted zones is prohibited.

7. Security & Studio Rights

  • CCTV Surveillance: The premises are under 24/7 video recording for the safety of all members and staff. Footage may be shared with law enforcement authorities when legally required.
  • Operational Updates: Management reserves the right to modify operating hours, class schedules, and services with prior notice provided via the official app or front desk.
  • No Outside Trainers: Bringing external personal trainers or coaches into the facility is strictly prohibited.
  • Right of Admission: Management reserves the right to refuse entry or terminate membership for any violation of studio policies without obligation to issue a refund.

8. Health, Safety & Assumption of Risk

  • Members participate in all fitness activities — including gym workouts, yoga sessions, group personal training, and use of recovery equipment — entirely at their own risk.
  • You acknowledge that physical exercise carries inherent risks of injury and agree that the Studio shall not be held liable for any injury, illness, or loss arising from the use of our facilities, provided reasonable safety measures were in place.
  • Members must immediately inform staff of any injury or medical incident that occurs on the premises.
  • Workout plans, diet plans, and guidance provided by trainers are for informational and motivational purposes only and do not constitute medical or professional health advice.

9. Group Personal Training (GPT)

  • GPT sessions are capped at a maximum of 6 members per batch to ensure personalized attention and quality of training.
  • Session schedules are set by the Studio and are subject to change based on trainer availability and batch requirements.
  • Missed sessions due to member absence are non-compensable and will not be rescheduled individually.
  • Members enrolled in GPT must adhere to the same Studio Etiquette standards and follow trainer instructions at all times during sessions.

10. Privacy & Data Usage

  • Personal data collected during registration (name, contact details, health information, ID) is used solely for the purpose of membership management and service delivery.
  • Data is stored securely and will not be sold or shared with third parties, except where required by law or for payment processing via authorized gateways.
  • CCTV footage is retained for a period as determined by the Studio and may be disclosed to law enforcement upon a valid legal request.
  • By using the Epic Fitness App, you consent to the collection and storage of workout data, steps, hydration logs, and other self-reported fitness data in accordance with this policy.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Epic Fitness Studio, its owners, managers, employees, and trainers shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our facilities or services. The Studio's maximum aggregate liability to any member shall not exceed the total membership fees paid by that member in the three (3) months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Epic Fitness Studio and its personnel from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to your violation of these Terms, your misuse of studio facilities, or any injury caused by your negligent or intentional actions on the premises.

13. Amendments to Terms

Epic Fitness Studio reserves the right to amend, update, or replace these Terms at any time. Members will be notified of material changes via the official app or notice at the front desk. Continued use of our facilities after any such changes constitutes acceptance of the revised Terms.

14. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Rajamahendravaram, Andhra Pradesh. The parties agree to first attempt resolution through good-faith negotiation before initiating formal proceedings.
